1The service
KODISAP helps landlords and tenants manage rental tenancies: rent collection through M‑Pesa, payment records and receipts, statements, reminders, utility billing, and related tools. KODISAP is a platform — we are not a party to any tenancy. The tenancy itself is governed by the separate agreement between a landlord and their tenant, available in the app.
2Accounts
- You must provide accurate information when registering, including a valid Kenyan M‑Pesa phone number.
- One phone number holds one account with one role (landlord or tenant).
- You are responsible for keeping your login credentials and device secure. Actions taken from your account are treated as yours.
- You may delete your account at any time in the app (Settings or Profile → Delete account) or as described at api.kodisap.com/legal/account-deletion.
3Payments and fees
- Rent and other charges are paid through M‑Pesa to Paybill 4052037. Your M‑Pesa PIN is entered only on Safaricom's prompt — it never touches KODISAP.
- A platform service fee applies to rent processed through KODISAP. The fee and who bears it (landlord, tenant, or split) are shown in the app before payment.
- Safaricom's own M‑Pesa charges may apply and are outside our control.
- Payment confirmations, receipts, and statements in the app reflect the records we receive from M‑Pesa. M‑Pesa receipt numbers are the authoritative reference for disputes.
4Landlord and tenant responsibilities
- Landlords are responsible for the accuracy of the property, unit, rent, and tenant details they enter, and for their legal obligations as landlords under Kenyan law.
- Tenants are responsible for paying what they owe under their tenancy and for the accuracy of the personal details they provide.
- Charges a landlord raises through KODISAP (rent, utilities, penalties, deposits) are between the landlord and the tenant. KODISAP records and routes them but does not set them.
5Acceptable use
Do not use KODISAP to break the law, defraud anyone, harass others, submit false information, interfere with the service, or attempt to access accounts or data that are not yours. We may suspend or terminate accounts involved in such conduct.
6Privacy
Our Privacy Policy explains what data we collect and how we handle it, in line with the Kenya Data Protection Act, 2019.
7Service availability
We work to keep KODISAP available and reliable, but the service depends on mobile networks, M‑Pesa, and other systems outside our control. The service is provided "as is"; we do not guarantee uninterrupted availability.
8Liability
To the extent permitted by Kenyan law, KODISAP's liability arising from the service is limited to the platform fees you paid us in the three months before the event giving rise to the claim. We are not liable for disputes between landlords and tenants, or for losses caused by events outside our reasonable control.
9Changes
We may update these Terms as the service evolves. Material changes will be announced in the app; continuing to use KODISAP after a change takes effect means you accept the updated Terms.
10Termination
You may stop using KODISAP and delete your account at any time. We may suspend or terminate accounts that breach these Terms. Financial records are retained as required by law even after account deletion.
11Governing law
These Terms are governed by the laws of Kenya. Disputes are subject to the jurisdiction of the Kenyan courts.
